New Seasons Concierge is a boutique travel and concierge service dedicated to helping travelers (“you,” “traveler,” or “client”) experience the beauty and culture of Florida through personalized planning, curated experiences, and seamless support from start to finish.
1) Contract
These Terms and Conditions (“Agreement”) form a legally binding contract between you and New Seasons Concierge. By requesting or confirming a booking, submitting information, or utilizing our services, you acknowledge that you have read, understood, and agree to these Terms.
This Agreement incorporates:
If you are booking on behalf of others (family, couple, or group), you confirm you are authorized to act for all travelers and agree to share these Terms with them.
You represent and warrant that you are of legal age, can create binding obligations, are authorized to act for those you represent, and that all information provided is accurate.
2) Scope of Services & Agency Relationship
New Seasons Concierge acts solely as an independent travel advisor and agent in arranging travel services (“Travel Products”) provided by independent third-party suppliers (“Suppliers”).
We do not own, operate, control, or manage the accommodations, transportation, excursions, or other travel services you book through us. Each Supplier is fully responsible for its own operations, terms, and policies.
By booking through New Seasons Concierge, you agree to abide by all applicable Supplier terms, including cancellation, refund, and liability provisions. We are not responsible for:

3) Booking & Payment
We provide complimentary assistance in connecting you with verified travel suppliers and managing booking logistics.
When you confirm your travel arrangements, you authorize New Seasons Concierge to coordinate with third-party Suppliers on your behalf and provide necessary details to secure your bookings. Payments are made directly to the Supplier(s) whenever possible, and all bookings are subject to Supplier payment terms and conditions.
If a Supplier requires a deposit or full payment, you will be notified in advance and provided with secure payment instructions or links.
4) Price & Rate Changes
All prices and rates are based on information provided by Suppliers and are subject to change until payment is confirmed. Prices may vary due to currency fluctuations, taxes, surcharges, or Supplier updates.
New Seasons Concierge has no control over price adjustments made by Suppliers and is not liable for differences arising after booking confirmation.
5) Changes, Cancellations & Refunds
All changes, cancellations, and refund requests are governed by the policies of the applicable Suppliers. New Seasons Concierge does not charge any service or administrative fees for assisting with modifications or cancellations.
If a Supplier issues a credit, voucher, or refund, that refund will be processed in accordance with their specific terms. We will assist you in communicating with the Supplier to facilitate the process but cannot guarantee reimbursement or credits.
6) Force Majeure
New Seasons Concierge is not responsible for losses or expenses due to events beyond our reasonable control (“Force Majeure”), including but not limited to: natural disasters, weather disruptions, strikes, civil unrest, pandemics, governmental actions, or Supplier insolvency.
Refunds or rebooking options in such circumstances are subject to Supplier discretion and availability.
7) Travel Protection Insurance
New Seasons Concierge strongly recommends that all travelers purchase comprehensive travel protection insurance.
Travel insurance may cover trip cancellation, delays, medical emergencies, or Supplier defaults. We are not licensed insurance producers and cannot guarantee coverage or claim outcomes.
If you choose not to purchase insurance, you assume full responsibility for any losses that would otherwise be covered.
8) Traveler Documentation & Responsibilities
You are solely responsible for providing accurate traveler details and ensuring that all names match government-issued identification or passports.
It is your responsibility to secure and comply with all necessary documentation (passports, visas, vaccinations, or other entry requirements).
New Seasons Concierge is not liable for denied boarding, entry refusals, or additional expenses resulting from missing or inaccurate documentation.
9) Credit Card Authorization & Chargebacks
By submitting payment through any Supplier or New Seasons Concierge platform, you authorize valid charges in accordance with Supplier terms.
You agree to contact us first to resolve any billing or service concerns before initiating a chargeback with your financial institution.
Improper chargebacks include (but are not limited to):
We reserve the right to dispute improper chargebacks and recover associated costs.
10) Limitation of Liability
To the fullest extent permitted by law, New Seasons Concierge’s total liability for any claim shall not exceed the amount of commission or compensation directly received by us for the booking in question.
We are not liable for indirect, incidental, consequential, or punitive damages, or for acts, errors, or omissions by any third-party Supplier.
11) Assumption of Risk & Waiver
Travel involves inherent risks, including but not limited to: transportation delays, weather, illness, injury, or other unforeseen events.
By engaging our services, you voluntarily assume all such risks and release Caribbean Concierge, its owners, agents, and employees from any liability arising from participation in travel arrangements, except in cases of gross negligence or willful misconduct.

You agree to indemnify and hold harmless New Seasons Concierge and its representatives from any claims, damages, or losses (including reasonable attorney’s fees) arising from:

All travelers are expected to act respectfully and responsibly while participating in booked services or excursions. Suppliers reserve the right to refuse service to any traveler who disrupts operations, endangers others, or violates local laws or Supplier rules.
You are responsible for any damage or loss caused by you or your party and agree to pay such charges directly to the affected Supplier.
14) Health, Disabilities & Pregnancy
Please inform us of any medical conditions, mobility limitations, or accessibility needs prior to booking so we can communicate them to Suppliers.
While we make every effort to accommodate requests, New Seasons Concierge cannot guarantee that specific accommodations or accessibility features will be available.
15) Intellectual Property & Media Use
All materials created or provided by New Seasons Concierge—including itineraries, travel guides, recommendations, and digital content—are the intellectual property of New Seasons Watersports LLC and may not be reproduced or distributed without written consent.
By sharing testimonials, photos, or tagging our business on social media, you grant New Seasons Concierge permission to use such content for marketing purposes unless you request removal in writing.
16) Website Terms of Use & Privacy
By using our website, you agree not to engage in unlawful, fraudulent, or disruptive activity. All website content is provided “as is,” and New Seasons Concierge makes no warranties regarding accuracy or third-party links.
Privacy:
We collect and store only the information necessary to plan and manage your travel. Personal data is kept confidential, securely stored, and never sold. You may request updates or deletion of your personal data by contacting info@newseasonswatersports.com.
We comply with applicable data protection laws including CCPA and, if applicable, GDPR. Please review our Privacy Policy for details.
17) Affiliate Disclosure
New Seasons Concierge may recommend or facilitate travel bookings through affiliate or commissionable relationships, including but not limited to:
We may receive commissions at no additional cost to you. Our affiliate partnerships do not influence the integrity of our recommendations, which are based on experience and service quality.
By booking through our links or referrals, you acknowledge and consent to these affiliate relationships.
18) Dispute Resolution, Governing Law & Venue
We aim to resolve all issues amicably. If a dispute cannot be resolved informally, both parties agree to binding arbitration in United States Virgin Islands, pursuant to the rules of the United States Virgin Islands.
This Agreement is governed by the laws of the United States Virgin Islands, and any legal proceedings shall be brought exclusively in the courts of the United States Virgin Islands.
19) Severability & Modifications
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in full force and effect.
New Seasons Concierge may update these Terms at any time. The most recent version posted on our website is considered binding.
Acknowledgment
By booking travel, submitting information, or using our concierge services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions, including our Privacy Policy and Affiliate Disclosure.
